“Minor issue” resolved — and consulates are now instructed to apply it

The Sezioni Unite ruled that a child who was a dual citizen from birth did not lose Italian citizenship when a parent naturalized during their minority (Art. 7, Law 555/1912). On August 10, 2026 the Interior Ministry issued Circular 65050 telling consulates and comuni to follow it, superseding the 2024 guidance for parent naturalizations between July 1, 1912 and August 15, 1992. Previously denied applicants are told to request a re-examination of their original application, not to re-file. Separately, the two-generation cap (Law 74/2025) is still before the EU Court of Justice.
